If Berisha also remains an MP in parliament, he cannot justify it by transferring the president's mandate. This is also the other oddity in the crisis situation. The new distribution of parliamentary mandates showed that most of the new seats, after the changes in parliamentary allocation, belong to the number that had won the elections. Soon the latest information reports that the new legislature of the People's Assembly will have the president inside by next Monday. That is also the expectation. In the past week and over the last few days, the arrangement of lists of MPs in various districts according to the new election results has also caused surprise. In some districts, some candidates who had initially been counted as winners have been left out after the recalculation. But the strangest event appeared in Tirana, where according to the PD list and the winning MPs, Sali Berisha appears at once as president of the republic and as an MP. On the other hand, constitutional jurisprudence and practice do not allow holding two modest posts, since the president's mandate is incompatible with that of an MP. Now a month is passing and it is argued that Berisha's presidential mandate could be considered consumed with the decree of the new government. Nevertheless, he cannot simultaneously hold the office of president and be elected as an MP without giving up the first post. For this reason, jurists and politicians await with interest how this unusual situation in the country's constitutional life will be resolved. If Berisha retains the presidency, then he must renounce the parliamentary mandate. Otherwise, if he enters parliament as an MP, he must leave the post of president. This dilemma has become the subject of numerous discussions in political and legal circles, since it is directly linked to the normal functioning of state institutions. In the tense climate after the deep political crisis of recent months, every formal act related to Berisha's mandate takes on special weight. From this perspective, the final election record is not only a technical step, but also a document with immediate institutional consequences. If it is signed and certifies the result in which Berisha appears as an MP, then Albanian institutions must quickly provide a clear solution. Otherwise, a vacuum or confusion would be created over the legitimacy of representation and the exercise of the highest state functions.
